1. Terms
These Terms of Service ("Terms") govern your access to and use of the services provided by Book The Lead LLC ("Company," "we," "us," or "our.").
Book The Lead provides automated communication and lead response services for local service businesses, including but not limited to missed-call text-back automation, appointment booking links, and review follow-up systems (the "Services").
By accessing our website or using our Services, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree to these Terms, you may not use our Services.
2. Description of Services
Book The Lead LLC provides automated communication tools designed to help local service businesses respond to inbound customer inquiries.
Our Services may include:
- Missed-call text-back automation
- Automated SMS responses
- Appointment booking links
- Review follow-up messaging
- CRM and communication workflow automation
We act as a technology provider facilitating communication between our clients and their customers. We do not provide roofing, restoration, or other field services directly.
We reserve the right to modify or discontinue any portion of the Services at any time.
3. Fees & Payments
Client agrees to pay all applicable setup fees and recurring subscription fees as outlined in the agreed service plan.
Subscription fees are billed in advance on a monthly basis unless otherwise agreed upon in writing.
All payments are non-refundable unless otherwise required by law.
Book The Lead LLC reserves the right to suspend or terminate Services for accounts with overdue balances.
Clients may cancel Services at any time by providing a written notice. Services will remain active through the end of the current billing cycle.
4. Client Responsibilities & SMS Compliance
Clients are solely responsible for ensuring that they have obtained all required consent from their customers prior to sending SMS messages, automated responses, appointment reminders, review requests, or any other communication through the Services.
Client represents and warrants that they comply with all applicable laws and regulations, including but not limited to the Telephone Consumer Protection Act (TCPA), A2P 10DLC requirements, and carrier messaging guidelines.
Book The Lead LLC acts solely as a technology provider facilitating communication workflows and does not initiate contact independently. The Client determines message content, recipients, and timing.
5. Limitation of Liability
To the fullest extent permitted by law, Book The Lead LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, lost business opportunities, or reputational harm arising out of or related to the use of the Services.
Book The Lead LLC does not guarantee that the Services will result in increased revenue, booked appointments, customer responses, or online reviews.
The Services are provided on an "as-is" and "as-available" basis. We do not warrant that the Services will be uninterrupted, error-free, or completely secure.
In no event shall Book The Lead LLC's total liability exceed the amount paid by the Client to Book The Lead LLC during the three (3) months preceding the event giving rise to the claim.
6. Suspension and Termination
Book The Lead LLC reserves the right to suspend or terminate Services at any time if the Client:
- Fails to make timely payments
- Uses the Services in violation of applicable laws or regulations
- Sends unlawful, unsolicited, abusive, or spam communication
- Engages in activity that jeopardizes carrier compliance or A2P registration
- Misuses or attempts to exploit the Services in a harmful manner
In cases involving suspected legal violations or carrier compliance risks, Book The Lead LLC may suspend Services immediately without prior notice.
Client may cancel Services at any time by providing written notice. Cancellation will take effect at the end of the current billing period.
Upon termination, access to the Services may be revoked and data retention is not guaranteed beyond thirty (30) days.
7. Indemnification
Client agrees to indemnify, defend, and hold harmless Book The Lead LLC, its owners, employees, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney's fees) arising out of or related to:
- Client's use of the Services
- Client's violation of any law or regulation
- Client's failure to obtain proper consent for communications
- Any claim brought by a third party related to messages sent through the Services on Client's behalf
This indemnification obligation survives termination of the agreement.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles.
9. Modifications
Book The Lead LLC reserves the right to modify these Terms at any time. Updated versions will be posted on our website with a revised "Last Updated" date.
Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
10. Disclaimer of Warranties
The Services are provided on an "as-is" and "as-available" basis without warranties of any kind, expressed or implied.
Book The Lead LLC disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Services will meet the Client's specific business objectives, generate revenue, produce customer responses, or improve online reviews.
